Case Study 1
Right of First Refusal
Acting for the participating leaseholders on a complicated right of first refusal matter of a block of 10 flats, exercising their rights of first refusal following service of their landlord’s section 5 offer notice. The landlord and her solicitor were often slow to progress the matter which created difficulties when complying with the strict time deadlines imposed by the Landlord and Tenant Act 1987 and required several extensions to extend the deadline for exchange of contracts.
The landlord had also granted a new lease of an additional unit in breach of the Ground Rent Act 2022 and required extensive advice on the implications of the same for our client. We remain involved in advising the client with regards to lease extensions for each participating leaseholder’s flat.
Case Study 2
Statutory Lease Extensions
Acting for a leaseholder portfolio investor client to advise it in respect of their next round of statutory lease extension claims for 118 properties having successfully completed an earlier round comprising 82 statutory lease extension claims. These lease extensions were complex and often involved following court processes following the landlord’s failure to serve a counter-notice in time/ at all.
Case Study 3
Voluntary Lease Extensions
Advising a leaseholder-owned freehold company on a voluntary lease extension project comprising 548 flats, which requires a significant amount of organisation and attention to detail to ensure nothing is overlooked. Every stage of the process is meticulously tracked to ensure the transaction progresses smoothly.
Case Study 4
Compulsory acquisition claim where landlord is missing
We are advising leaseholders on a claim to acquire their freehold under the compulsory acquisition provisions in Part III the Landlord and Tenant Act where the landlord is missing and where the landlord is in breach of their obligations under the lease. In this case it is beneficial to the clients to follow this procedure rather than the missing landlord provisions in the Leasehold Reform Housing and Urban Development Act 1993.
