Sussex-based Right to Manage Federation (RTMF) has successfully assisted the leaseholders of a multi-storey London residential apartment development – Metro Central Heights - to win the biggest Right to Manage (RTM) case the UK has ever seen.
Metro Central flat owners were motivated by wanting more control over decisions and expenditures and despite many flat owners living overseas, 248 out of 422 leaseholders supported the RTM application.
RTMF’s Nick Bignell commented: “It’s a brilliant example of how, with professional guidance a lessee community can come together, fight a powerful landlord and come out on top.”
RTMF took the case to the Leasehold Valuation Tribunal to fight the Landlord’s counter-notice and represented by its solicitor, Margarita Mossop, won a favourable judgement.
Speaking on behalf of the Residents’ Association, Professor Bob Nobay, said: “The Right to Manage will enable us to get better value for money by allowing us to tender contracts, but the added control it entitles us to will be vital in the day-to-day management of the block and its upkeep.”
Performance of the existing managing agent, Consort Property Management (part of the Peverel Group) will now be monitored over the next 12 months before the RTM company decides to tender for a new managing agent.
Since 2006, the RTMF has successfully completed RTM for over 3,400 properties of which around 1,600 were previously managed by Peverel companies such as OM Property Management, Consort Property Management and Peverel Retirement.
