The Property Ombudsman (TPO) has expelled five property firms—three estate agents and two letting agents—for failing to comply with compensation awards made to consumers.
Among the cases, Prime Property Agents in Nottingham was ordered to refund a £7,200 reservation fee after a failed purchase and pay an additional £200 for distress, totalling £7,400. The firm did not adhere to its own terms and conditions after failing to offer alternative properties or return the fee.
In Devon, Cowlings Estate Agents in Bideford was told to pay £1,087 to sellers after falsely confirming a buyer was purchasing in cash. The deal later collapsed when it emerged the buyer was seeking finance. Nearby, Nexmove (NXMVETGN Ltd) in Teignmouth faced similar issues, failing to confirm a buyer’s financial position. TPO awarded £400 in that case.
Letting agents were also among those sanctioned. The Jolly Landlord in Essex failed to transfer a tenant’s deposit and rent to the landlord, resulting in the early termination of management and tenancy agreements. £350 was awarded to the tenant. Meanwhile, Lilypad Estates London withheld eight months of rent from a landlord and ceased communication. They were ordered to pay £200, plus the missing rent.
All five businesses have been referred to property portals and Trading Standards as part of the expulsion process. TPO confirmed that a total of nine firms have been removed from the scheme so far in 2025.
Interim Ombudsman Lesley Horton said:
“Expulsion is a last resort and that’s evident in the low numbers. We always strive to be very clear and explain the evidence that has led to our decisions and any award we make… 99% of businesses comply with our decisions and pay awards when directed.”
TPO continues to carry out audits to ensure agents are following best practices and relevant regulations.
