Tenants win right to gain contact information from landlords

Tenants’ associations are being given the right to gain contact information from their landlord so they can reach out to other residents in their block with a view to joining the association.

The move will boost the power of tenants’ associations, which have the right to be consulted on issues such as the appointment of managing agents and the level of service charges, and have the right to appoint a surveyor for advice.

Under Section 130 of the Housing and Planning Act 2016, the secretary of a tenants’ association will have the power to seek contact details of other leaseholders in a shared block, as long as they have agreed to having their details made available.

The act, which came into effect in July, introduces several regulations, including:

  • Landlords must make provision to provide tenants’ contact information;
  • Imposing time limits on landlords for providing information;
  • Landlords must seek consent from individual tenants to provide such information;
  • Identify how many tenants have not consented;
  • Authorise a landlord to charge costs specified in the regulations;
  • A court or tribunal will have the power to make an order should landlords fail to comply.
